CASE FILE — PROCEDURE
Money Claim Online
Filing a money claim through MCOL, from account setup to the defendant's response window.
Money Claim Online (MCOL) is HM Courts and Tribunals Service's online filing system for money claims. It applies to claims for a fixed sum against no more than two defendants, each with an address in England or Wales, where the total claim — including interest — does not exceed £99,999.99. Claims outside these limits, or claims seeking a non-monetary remedy, are filed on paper using form N1 instead.
Filing Steps
- Register for an MCOL account at moneyclaim.gov.uk, providing name, address, and payment details.
- Enter the claim: the defendant's name and address, the amount claimed, interest (if claimed), and particulars of claim describing the basis of the debt or breach.
- Submit the claim and pay the issue fee online — see REC-04 — Court Fees for the fee schedule.
- The court serves the claim on the defendant. The response window opens on the deemed date of service and runs for 14 days, extended to 28 days if the defendant files an acknowledgment of service within the first 14.
After Filing
The defendant can respond by paying in full, admitting the claim in whole or in part, filing a defence, or doing nothing. If no response is filed within the deadline, the claimant can request default judgment through the MCOL system. If a defence is filed, both parties complete a directions questionnaire and the claim proceeds to allocation — see REC-01 — How To Make A Claim for what follows.
